Soldiers Charged With Home Invasion

FORT DRUM, New York - Military charges have been brought against 10 of the 11 Soldiers arrested by New York state troopers for breaking into the home of another military couple and assaulting them last month, the U.S. Army said Wednesday.

The charges involve violations of the Uniform Code of Military Justice and include conspiracy, aggravated assault and burglary.

Article 32 hearings, similar to a civilian grand jury hearing, are tentatively scheduled for next week. The investigating officers will review the charges and evidence and recommend whether there is sufficient evidence to warrant trial by courts-martial.

The Soldiers, all assigned to the 10th Aviation Brigade's 3rd Squadron, 17th Cavalry Regiment, were accused of pushing their way into the off-post home of Carl Laws, 22, and his wife, Emily Hernandez, 21, on April 25. Both suffered minor injuries.

State police said the attack was retaliation after the couple filed a criminal complaint that led to the arrest of another soldier. That soldier was not involved in the assault.

Local prosecutors turned the case over to the Army.

Three of the Soldiers charged remain in pretrial confinement. The other seven soldiers were placed under the control of their unit.

The Soldier who was not charged has been returned to the unit and will deploy to Iraq soon. The rest of the unit went to Iraq earlier this month.
