Was Pat Tillman Murdered? AP Gets New Documents

SAN FRANCISCO — Army medical examiners were suspicious about the close proximity of the three bullet holes in Pat Tillman’s forehead and tried without success to get authorities to investigate whether the former NFL player’s death amounted to a crime, according to documents obtained by The Associated Press.

0727 08“The medical evidence did not match up with the, with the scenario as described,” a doctor who examined Tillman’s body after he was killed on the battlefield in Afghanistan in 2004 told investigators.

The doctors - whose names were blacked out - said that the bullet holes were so close together that it appeared the Army Ranger was cut down by an M-16 fired from a mere 10 yards or so away.

Ultimately, the Pentagon did conduct a criminal investigation, and asked Tillman’s comrades whether he was disliked by his men and whether they had any reason to believe he was deliberately killed. The Pentagon eventually ruled that Tillman’s death at the hands of his comrades was a friendly-fire accident.

The medical examiners’ suspicions were outlined in 2,300 pages of testimony released to the AP this week by the Defense Department in response to a Freedom of Information Act request.

Among other information contained in the documents:

  • In his last words moments before he was killed, Tillman snapped at a panicky comrade under fire to shut up and stop “sniveling.”
  • Army attorneys sent each other congratulatory e-mails for keeping criminal investigators at bay as the Army conducted an internal friendly-fire investigation that resulted in administrative, or non-criminal, punishments.
  • The three-star general who kept the truth about Tillman’s death from his family and the public told investigators some 70 times that he had a bad memory and couldn’t recall details of his actions.
  • No evidence at all of enemy fire was found at the scene - no one was hit by enemy fire, nor was any government equipment struck.

The Pentagon and the Bush administration have been criticized in recent months for lying about the circumstances of Tillman’s death. The military initially told the public and the Tillman family that he had been killed by enemy fire. Only weeks later did the Pentagon acknowledge he was gunned down by fellow Rangers.

With questions lingering about how high in the Bush administration the deception reached, Congress is preparing for yet another hearing next week.

The Pentagon is separately preparing a new round of punishments, including a stinging demotion of retired Lt. Gen. Philip R. Kensinger Jr., 60, according to military officials who spoke on condition of anonymity because the punishments under consideration have not been made public.

In more than four hours of questioning by the Pentagon inspector general’s office in December 2006, Kensinger repeatedly contradicted other officers’ testimony, and sometimes his own. He said on some 70 occasions that he did not recall something.

At one point, he said: “You’ve got me really scared about my brain right now. I’m really having a problem.”

Tillman’s mother, Mary Tillman, who has long suggested that her son was deliberately killed by his comrades, said she is still looking for answers and looks forward to the congressional hearings next week.

“Nothing is going to bring Pat back. It’s about justice for Pat and justice for other soldiers. The nation has been deceived,” she said.

The documents show that a doctor who autopsied Tillman’s body was suspicious of the three gunshot wounds to the forehead. The doctor said he took the unusual step of calling the Army’s Human Resources Command and was rebuffed. He then asked an official at the Army’s Criminal Investigation Division if the CID would consider opening a criminal case.

“He said he talked to his higher headquarters and they had said no,” the doctor testified.

Also according to the documents, investigators pressed officers and soldiers on a question Mrs. Tillman has been asking all along.

“Have you, at any time since this incident occurred back on April 22, 2004, have you ever received any information even rumor that Cpl. Tillman was killed by anybody within his own unit intentionally?” an investigator asked then-Capt. Richard Scott.

Scott, and others who were asked, said they were certain the shooting was accidental.

Investigators also asked soldiers and commanders whether Tillman was disliked, whether anyone was jealous of his celebrity, or if he was considered arrogant. They said Tillman was respected, admired and well-liked.

White House Rebuffs Congress on Tillman Papers

WASHINGTON — The White House has refused to give Congress documents about the death of former NFL player Pat Tillman, with White House counsel Fred Fielding saying that certain papers relating to discussion of the friendly-fire shooting "implicate Executive Branch confidentiality interests."

Reps. Henry Waxman, D-Calif., and Tom Davis R-Va., the leading members of the House Committee on Oversight and Government Reform, objected to the refusal Friday in letters to the White House and the Defense Department.

White House and Pentagon officials have turned over about 10,000 pages of material, but Waxman and Davis said those papers lack critical documents that would show communications between senior administration officials and top military officers shortly after Tillman was killed in Afghanistan in 2004.

Tillman's celebrity, as one who gave up a professional football contract to join the Army after the Sept. 11, 2001, attacks, made his death major news. The military at first concocted a heroic story about how Tillman, a specialist posthumously promoted to corporal, had been killed in a fierce firefight with the enemy, despite obvious evidence that he had been shot by his own men at close range. More than a month later, a military investigation reported publicly that the death was not linked to enemy fire.

"The main focus of the committee's investigation is to examine what the White House and the leadership of the Department of Defense knew about Corporal Tillman's death and when they knew it," Waxman and Davis wrote in a letter to Fielding. "Unfortunately, the document production from the White House sheds virtually no light on these matters."

After an oversight hearing in April — during which Tillman's family members testified — the committee sought the documents to learn about the alleged coverup and high-level discussions about how to spin the case. Waxman and Davis plan another hearing on Aug. 1.

The former US private Jessica Lynch today condemned what she said were Pentagon efforts to turn her into a "little girl Rambo", and accused military chiefs of using "elaborate tales" to try to make her into a hero of the Iraq war.

Speaking at a congressional hearing on the use of misleading information, an emotional Ms Lynch described how she suffered horrific injuries when her vehicle was hit by a rocket near the Iraqi town of Nasiriya in March 2003, killing several of her companions.

The US military has come under criticism for allegedly spinning stories from Iraq and Afghanistan. The hearing is also looking at the case of the American football star-turned-solider Pat Tillman, who died in a friendly fire incident in Afghanistan in 2004.

The Pentagon initially put out the story that Private Lynch - a slight woman who was just 19 at the time - had been wounded by Iraqi gunfire but kept fighting until her ammunition ran out. In fact, her gun had jammed and she did not fire a shot.

A video of US commandos carrying her from a Nasiriya hospital was released at the height of the conflict.

Ms Lynch has criticised Pentagon efforts to use her for propaganda purposes before. But her appearance today, before the House committee on oversight and government reform, chaired by an ardent Bush administration critic, congressman Henry Waxman, inevitably will take on a political dimension at a time when the White House is under strong pressure on Iraq.

Mr Bush today reiterated his pledge to veto a funding bill, approved by the Democratic-controlled Congress, that sets a deadline of next April for US troops to withdraw.

Ms Lynch criticised the Pentagon, saying: "I'm still confused why they lied and tried to make me into a legend." Ms Lynch said the real heroes were those who died in the attack and those who rescued her.

Initial reports also suggested that Ms Lynch had been abused after she came round in the hospital. She said the reports were lies: she had been treated well and the Iraqis had tried to return her to US forces.

"The nurses tried to soothe me and return me," she told the hearing, adding that she objected to the way in which the US military had portrayed her.

"American people don't need to be told elaborate tales" about US forces, she said.

Pat Tillman's relatives were not told of the true circumstances of his death until five weeks after his funeral. The Pentagon initially informed them that he had died while storming an enemy position, a version it quickly realised was wrong.

Private Tillman's death received worldwide attention because he had turned his back on a $3.7m (£2m) contract with the NFL team the Arizona Cardinals to enlist in the forces after the September 11 2001 attacks.

In a report in March, the Pentagon's inspector general said Mr Tillman's relatives had not been told the truth even though commanders knew soon after his death that he had probably been killed by fellow soldiers.

He recommended that action be taken against nine officers, including a number of generals, but found no evidence of criminal wrongdoing or any deliberate cover-up.

The committee issued its first subpoena since Democrats took power and Mr Waxman became committee chairman. Dr Gene Bolles, the neurosurgeon who treated Ms Lynch in Germany after she had been rescued in Iraq, was the target of the subpoena.

WASHINGTON - As the Army probed Pat Tillman's death, investigators implored the CIA and Pentagon last year to scour their databanks for aerial video of the friendly fire incident, footage they believed might have been captured as a Predator drone flew over the scene.

The trail ran cold in October, but lawmakers plan to press the Pentagon on Tuesday with questions still hovering over the one-time National Football League star's shooting: Was a drone flying overhead when Tillman was killed? Did it videotape the incident, and if so, where is the footage?

Some members of Congress hope to elicit the new information Tuesday when the House Committee on Oversight and Government Reform holds a hearing as part of an investigation into misleading information from the U.S. military.

The most recent investigation by the Army, released last month, documented a monthslong search for the video. The undertaking "suggests the distinct possibility that a Predator drone overflew the battle scene, and, if it did, may have captured yet-unrevealed material information," said Daniel Kohns, a spokesman for Rep. Mike Honda, a Democrat who represents the San Jose, Calif., area where Tillman grew up.

"Representative Honda intends to question Pentagon and Army officials on this issue and, at long last, elicit definitive answers to this and other questions that inexcusably continue to linger over this matter," Kohns said.

The hearing will cover both Tillman's death three years ago and the 2003 rescue of Pfc. Jessica Lynch in Iraq - a story embellished by the military after her videotaped rescue by special forces.

For the hearing, the committee issued its first subpoena since Democrats took power and Rep. Henry Waxman, D-Calif., assumed the chairmanship in January. The target of the subpoena was Dr. Gene Bolles, the neurosurgeon who treated Lynch in Germany after she was rescued in Iraq.

Bolles will be a witness Tuesday, as will Lynch. Also testifying will be Tillman's mother; his brother Kevin, who was nearby when Pat Tillman was killed; and Spc. Bryan O'Neal, who was next to Tillman when he was killed.

Acting Defense Department Inspector General Thomas Gimble and Gen. Rodney Johnson, the head of the Army's Criminal Investigation Command - who both completed investigations last month on Tillman's death - also will appear.

The drone, equipped with a video camera in its nose, had been flown by the CIA over Afghanistan in search of Osama bin Laden for several years. After Sept. 11, 2001, the little plane also was outfitted with missiles and used to kill al-Qaida leaders.

An Air Force commando attached to Tillman's Army Ranger platoon testified that as the incident unfolded, he heard the unmanned reconnaissance plane's distinctive propellor buzz overhead.

"I remember hearing an aircraft that I initially suspected was a C-130 but as I listened closer I knew it was a Predator drone," he told Army investigators.

His belief was later confirmed by a comrade at their tactical operations center, he said. "I was told it was over us during the ambush," this airman testified. His name was blacked out of documents the Army released last month.

The Air Force commando was something of an expert in aircraft sounds. As an "enlisted terminal attack controller," his job was to call in and then direct "close air support" or aircraft that could fire on the enemy in the kind of ambush that preceded Tillman's death.

Moments after hearing that attack on his fellow Army Rangers, the airman radioed a command center and requested air cover. No attack aircraft arrived to help.

His recollection of the Predator was enough to spark a search for any video the drone might have gathered. That search spanned six months, took investigators close to the highest reaches of the Pentagon and touched upon some of the most sensitive technology the United States possesses.

In September, Army security officials directed that investigators' memos seeking Predator footage be classified "SECRET/NOFORN," meaning no foreigners would be permitted to see the memos.

Special agents for the Army Criminal Investigation Command and the Defense Department inspector general's office spent much of last summer trying to track down the video - or determine whether it existed. Among other agencies, the agents reached out to "Psychological Operations, the Pentagon ... regarding the Predator footage which was taken during the Tillman incident."

A former U.S. commander in Afghanistan told investigators that "the chances of footage being taken at the incident location during that time frame is minimal."

Still, the investigators met with Lt. Gen. William G. Boykin, the Pentagon's deputy undersecretary for intelligence, who said "he would coordinate with the Central Intelligence Agency and ensure a review for the requested imagery is conducted."

In October, however, the conclusive results came back from Navy Vice Admiral Eric T. Olson, deputy commander of the Special Operations Command: No video of the friendly fire episode was "known or suspected to exist."

Tillman's death received worldwide attention because he had walked away from a huge contract with the NFL's Arizona Cardinals to enlist in the Army after the Sept. 11 terrorist attacks.

Was Pat Tillman assassinated? Don't put anything past this crop of killers, liars, propagandists, fascists and traitors

Pat Tillman: Killed by Friendly Fire or Executed by His Own Government?

The Bush Administration knew at the top that celebrity soldier Pat Tillman had been killed by persons in, or attached to his own unit, yet it purposely chose to muffle the incident for more than two years; lying to the family while lionizing the victim as a war hero. Circumstantial evidence, primarily illogical actions at very high levels of the administration, suggests more than a cover up of a “friendly fire” accident (a common mistake during war.)

Had Tillman been accidentally shot by one of his own unit the whole matter could have been put to rest by holding a few harsh court marshals of those immediately involved, and issuing profuse apologies to everyone. But, America’s most famous volunteer soldier was, according to his brother and constant companion, on the verge of whistle-blowing the bankruptcy of US policy in Iraq. The untimely death of Tillman could not have been timelier for the top civilians in charge of making war, but covering for an assassination is not so simple.

The Tillman brothers were both professional athletes who enlisted in the US Army together in May 2002, 8 months after day 9/11, but before the bombing of Iraq. They were first shipped to Iraq where they lived together in the same unit; then they were transferred to Afghanistan where Pat Tillman was killed about two years after his enlistment by parties unknown. The Army now admits Tillman was killed by his own unit, but there appears to be much more to the story. Tillman’s own brother Kevin, who was with him every day, says Pat despised and rejected the war in Iraq as unnecessary and brutal. Kevin wrote a public letter on 20 October 2006:

"Somehow the most reasonable, trusted and respected country in the world has become one of the most irrational, belligerent, feared, and distrusted countries in the world." (1)

The Not So New Military Art of Selective Execution…of its Own

Pat Tillman's family has firmly rejected the Defense Department's findings on the former NFL star's friendly-fire death in Afghanistan; calling for congressional investigations into what they see as broad malfeasance and a cover-up. They are told in the reports that nine Army officers, including four generals, “made errors” in not reporting the friendly fire death to their superiors and to the Tillman family. The Defense Department has stated one or more of those officers who provided misleading information as the military investigated could be charged with a crime. However, there is a gaping hole in this story. It has now been disclosed that the “friendly fire” story of his death had to be known at the top of the chain of command, probably by Bush and acting Army Secretary Les Brownlee. (2)

Logic dictates that we raise the possibility of Tillman’s assassination by his own government. Top civilian leadership had the reason and the opportunity to assassinate Tillman, and now they are acting quite guilty.

The Tillman story has a great chance of breaking out: survivor Kevin Tillman was with his brother constantly at war. Pat and Kevin were shipped from Iraq to Afghanistan because Pat made no secret of his opinion that war in Iraq was “illegal and unjust,” and he was, according to his brother, prepared to tell his story publicly at the first opportunity. The Tillman brothers were due for a furlough, and Kevin stated in interviews that Pat had arranged to meet with an anti-war journalist while at home. We wonder if others might have known this.

We do not know if Pat ever admitted he had been fooled into enlisting, but he privately denounced the destruction of war in Iraq as immoral and brutal. As Pat’s outrage grew, he was probably reassigned before he could refuse to serve in Iraq. It does not appear he renounced his original ideas about fighting the war on terrorism, presumably against the Taliban in Afghanistan.

Justifiable Homicide

When O. J. Simpson was found not guilty of the murders of his wife and her friend Ron Goldman, some Americans believed the Court. OJ is a football hero with a fan club, and others simply believe that courts render correct decisions. Fewer now believe OJ’s innocence, especially after he tried to market a book on how he would have killed his wife if he had wanted to. But he stands innocent under the law.

The same types of questions were asked of the assassination of President John F. Kennedy (JFK) in 1962 only to be shouted down by the Warren Commission. It now seems all too obvious that Lee Harvey Oswald did not, and could never have carried out such plot alone, if indeed he even knew about the plan. Had Kennedy been touring Afghanistan when he was murdered it would no doubt have been called a “friendly fire” accident.

And there are older plots, Pearl Harbor being one, where the original story taken at face value is now rejected by many scholars. The complicity of the US government in 1941 is now an accepted historical conclusion that seriously challenges the “official story.” For many years any critic who saw the obvious inconsistencies was muzzled by labels of “conspiracy nut” and even “traitor.”

And how could two airplanes bring down no less than three buildings in Manhattan? A few challenged the accepted official story, and more are now asking. Pat and Kevin Tillman were caught up in the emotion of the moment and believed, not thinking past what seemed so obvious. But when the US bombed Iraq, Tillman knew something was very wrong, as his brother tells us. Perhaps Pat knew he had made an error in judgment that he would need to correct. His story seems to tell us this, and his superiors had to know about his change of heart, for they shipped the brothers from Iraq to Afghanistan without leave to go home.

It seems overwhelmingly likely that Tillman was not a victim of fratricide or “friendly fire” as it is euphemistically called, but was deliberately assassinated. Much of the daily killing is performed by “contractors” in Iraq. Tillman may not have been shot by anyone in the military. The Tillman “probable assassination” (our word) would have been temptingly easy, for instance for the CIA, which runs and hides secret prisons and torture camps, and creates false identities at will. It could have been carried out with the knowledge of a mere handful of persons above Army level, including as few as one assassin. It has been asserted that even now some of Tillman’s unit cannot be located for questioning. This would seem nearly impossible in an Army that maintains detailed personnel records, but likely if the CIA was involved. And we are told Pat’s personal diary was burned with his body armor- if this is true, we can only wonder what was in this diary.

This author’s purpose is limited to suggesting that someone above the military had a very good motive and opportunity to kill Tillman. Now the Army has a very guilty look as those above the army finger officers far up the chain of command. People who were carrying out orders are now implicated in the “friendly fire accident;” their faces shine in the light of a whitewashing investigation. The four generals and dozens of lesser officers and enlisted men are probably scapegoats; pleading incompetence and error at lower levels to take the wrap for the planners and executioners. The few in prison for torturing humans at Abu Ghraib had to take the blame for those who issued the orders.

The Motive for Assassination:

Pat Tillman was perhaps the most dangerous man to the war propaganda effort on April 22, 2004 when he died. Unlike his brother Kevin, his father Patrick Sr., or any other member of the armed forces, Pat could arrange publicity for what he had to say any time he warned to. Reportedly he told Kevin they would have to wait until they mustered out to talk. Few can raise a crowd faster than an articulate NFL star. Tillman is one of the few who could sing with certain credibility this marching cadence:

“I once was blind, but now I see.

I enlisted to fight

But soon I’ll be free.

Been there, I’ll talk;

You can believe in me.”

Circumstantial Evidence of an Assassination

Most of us have glimpsed the several coroner shows now so popular on TV, where every shred of evidence is saved and protected to expose the crime; no eyelash is ever lost or discarded. But Tillman’s clothing and body armor, as well as his personal diary were all burned. Those who destroyed it have yet to name those who told them to do so, and they may never tell. Everything about the killing suggests it was intended, including the fact that Tillman was shot twice in the head in broad daylight. Anyone good enough and close enough for a headshot can identity who is being shot. Maybe this is why his body armor was destroyed; perhaps it proved the assassins shot at his head, and did not pelt him with dozens of randomly placed rounds. “Friendly fire” is thought of as randomly sprayed artillery or gunfire that hits unintended individuals. It is truly not meant to be fratricide. Not so with assassination; there is nothing friendly about it.

The Motive to Kill

The army had another reason to fear Tillman- his incredible determination to do what he believed was right. This focus caused him to misguidedly enlist; believing the World Trade Center bombing was as advertised. We do not know what he believed when someone posing as an American in his own unit shot him in the face! The military had a valid motive for killing its poster boy…to keep him from talking very loudly about Iraq. Kevin Tillman has said in interviews that Pat had interviews arranged when he got stateside. He never made it home alive!

The Opportunity Was Present

Anyone who has ever witnessed the confusion of military field exercises can imagine how easy it would be to assassinate one individual during actual combat. Men are moved in and out of units under “orders” which mysteriously appear from above or are carried in the hands of a new recruit. A team of assassins could be ordered into a unit one week and ordered out the next week, with no one knowing their real names. They become who their orders say they are. Furthermore, those in a unit have no contact with the press or anyone else, nor do they dare talk if they did know someone to tell; they are under the total control of the unit. Pat Tillman could have been ordered into a unit at the same time as a hit team was ordered in to assassinate him. No one would be the wiser except the one who “cut the orders.” No one could say for sure if the assassin aimed at Tillman’s face or not.

Patrick Tillman Sr. said: “The army killed its poster boy.”

Responsibility for killing Tillman might reach very high indeed in this administration. Kevin Tillman will be safer if he puts every thought on paper and places them in public hands. We Hold These Truths leaves this endeavor to the Tillman family and many of their friends, with our blessings. We consider it more our forte to focus on the whitewashing of war by the Christian Right, of which Pat Tillman was, according to his friend Jeremy Staat, not part. Oddly, he did display moral courage and the desire to right his own wrongs. Bible teachers refer to such actions as virtue and repentance; qualities much talked about in Christian circles yet seldom practiced in time of conflict. Let us not allow Pat Tillman’s concern for his fellow man to be in vain.
